1. Definitions

• "Company" refers to Jaivarad Logistics Pvt. Ltd.
• "Client" or "Customer" refers to any person or entity availing our services.
• "Services" refers to transportation, logistics, freight, and related services provided by the Company.
• "Shipment" refers to goods, cargo, or materials transported under our services.
• "Consignee" refers to the person or entity designated to receive the shipment.

2. Service Agreement

A service agreement is formed when the Client accepts a quotation or booking confirmation from the Company. All services are subject to these Terms and any specific conditions mentioned in the booking confirmation or invoice.

3. Client Obligations

• Provide accurate and complete shipment information including weight, dimensions, and nature of goods
• Properly package and label goods suitable for transportation
• Disclose any hazardous, fragile, or special handling requirements
• Ensure goods are ready for pickup at the agreed time and location
• Pay all charges as per the agreed payment terms
• Comply with all applicable laws regarding the goods being transported

4. Pricing and Payment

• All quotations are valid for 7 days unless otherwise specified
• Prices are subject to change based on fuel surcharges, toll charges, and government levies
• Payment terms are as agreed in the booking confirmation (typically net 15 days for approved clients)
• Late payments will attract interest at 1.5% per month on the outstanding amount
• The Company reserves the right to suspend services for overdue accounts

5. Delivery Timelines

While we endeavor to meet all delivery timelines, estimated delivery dates are indicative and not guaranteed. The Company shall not be liable for delays caused by circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, government actions, traffic conditions, or force majeure events.

6. Insurance and Liability

• Basic carrier liability as per applicable transport laws applies to all shipments
• Clients are strongly advised to arrange comprehensive transit insurance for high-value goods
• The Company's liability for loss or damage shall not exceed the declared value of the shipment or applicable statutory limits
• Claims must be reported in writing within 7 days of delivery or the expected delivery date
• The Company is not liable for indirect, consequential, or punitive damages

7. Claims Process

• All claims must be submitted in writing with supporting documentation
• Claims must include photographs of damaged goods (if applicable)
• Claims will be investigated and resolved within 30 business days
• Settlement of claims will be at the discretion of the Company based on investigation findings

8. Prohibited Goods

The Company will not transport:

• Illegal substances, contraband, or stolen goods
• Hazardous materials without proper documentation and packaging
• Explosives, firearms, or ammunition
• Live animals or perishable goods without prior arrangement
• Any goods prohibited by applicable laws

9. Cancellation

Cancellations made before vehicle dispatch will not attract charges. Cancellations after dispatch will be subject to full or partial charges based on the distance covered and expenses incurred.

10. Force Majeure

The Company shall not be liable for failure to perform its obligations due to events beyond its reasonable control, including natural disasters, pandemics, war, terrorism, strikes, government actions, or other force majeure events.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Maharashtra, India.

12. Modifications

The Company reserves the right to modify these Terms at any time. Updated terms will be posted on our website. Continued use of our services constitutes acceptance of the modified Terms.
